I think (I'm not a lawyer) no one can claim a trademark for a common word unless they invented the word (like Google).

I too recently discovered this as they don't do business with people in Missouri. Honestly, I just signed up with eBay rather than declaring my companies business in Kansas, though.

I would suggest finding a different affiliate program entirely, depending on your chosen niche it might not be too difficult...
If the state banned Amazon or Amazon won't allow citizens out certain states to participate, trying to find a work around might not be worth it.....
It's looking like the only possible legal workaround is dual citizenship/filing taxes in another state
I see.. I had originally thought about using my grandmas account (who lives in Texas) and having her gift the money to me via paypal, don't want her to be liable for any taxes though... I'm sure I'll figure something out.

Sure! Definetly the health/exercise niche, however more along the lines of natural health, the reason I'd like to start up with Amazon is
because I shop there personally and I know they have the best deals
on the products I would be promoting to people.
That being said, I've done a little research in to other affiliate programs most of them can beat Amazon's 4%. Once I find a site I would order from, I'll have no problem promote their products, may take awhile XD
