This is exactly what has been making me wonder... FTC guidelines clearly state that "As for where to place a disclosure, the guiding principle is that it has to be clear and conspicuous. The closer it is to your recommendation, the better."

So, how come professionals (and I've seen this happen tons of times) end up putting this info just in the footer?
How do they keep out of trouble?
'BEcause their homepage is short.
