OMG!!! Neighbour trepass!!!!!!!!!!!!

Sorry about this post, have to vent. I come home today and discover that 1/2 my tree has be cut down in my backyard. 2 Beautiful branches lopped. The thing is in Australia you are really only allowed to cut branches that overhang the fence. This neighbour climbed the fence and hacked it 2 meters from the fence!!!! Came into my backyard!!

I am so shocked at this. And do you think he apologised oh no he called me a f###ing c###

So pissed off about this. Apparently the leaves were falling in his pool.

I am quite a reasonable person if he had spoken to me I would of agreed to having it pruned (not to that degree though)!!

Anyone had anything similar happen?

NO!! But I can MOST certainly understand how you feel. Precisely why I live out in the boonies and my nearest neighbor is about 200 yards away. Another way to maybe help choke this down is..........as he came back at you with such verbal vengeance, I would consider that there must be something else behind this that is really troubling your neighbor; something in his personal life...wife just asked for a divorce, just got fired, etc. This situation with the tree was just a convenient way for him to vent. Kinda depends on how you all have gotten along in the past.

I don't know the rules in Australia. Here in America and in the state of New Mexico. (Because rules can be different in each state) we are not allowed to just automatically cut down a tree or part of it in our neighbor's yard. It doesn't matter if the leaves are falling in our yard or not. We virtually have to agree with each other about getting it pruned.

I know this though, your neighbor sounds like a bully and controller to me. He just more or less took the situation into his own hands and did what he wanted to do. He felt he had the power to do this and you had no power and no choice.

This seems to be the kind of person that will do whatever he wants to do and you have no choice. He will always have this power over you if you give it to him. I would do something about it, but at this time I don't know what I would do because I don't know Australia laws about trespassing. I would ask the police or somebody in office and find out.

It is a hard to decide what to do though. If you do nothing, then he will think he can do it again and also maybe anything else he wants to do. If you confront him again (legally) he may even take some sort of revenge.

This is sad that a person thinks that they can do this to someone else though.

I agree with you, I think he is trying to bully me, and like you said if he gets away with it he might keep on thinking he can push me around.

No I've never had that happen. You could probably call the police if you really wanted to and file a complaint.

I did file a police report. Basically just want him told so he doesn't do it again!

I've had noisy neighbors (really terrible ones). It's not easy to resolve these sorts of situations. I understand your fury - but try not to let it escalate. It's not worth it especially with someone with that attitude.

He did come and knock on my door and apologise. I don't want to let it escalate but tried to make him understand the seriousness of him trespassing on my land. Hopefully it has sunk in. I did file a police report mainly so he would get told it's not ok so it doesn't happen again! Thanks for your comment.
