As early as December 2009, the FTC released guidelines that require any affiliate who promotes products to clearly disclose the fact that they receive compensation for doing so. So, yes, you do need one. It is the law.

However, policing and enforcing this law is obviously an issue, so you probably don’t have much to fear if you don’t have one. However, I believe it is better to be transparent and honest. There are creative ways to include disclosures and I don’t think customers with whom you have built up a trusting relationship will have any issues about you receiving some compensation for your efforts.

Thank you. It makes sense to do so, but I receive so many emails from marketers that have affiliate links and no disclosure. I don't really have an example of how you place the affiliate disclosure in an email. Any suggestions?

I have an affiliate disclaimer at the bottom of all my emails in the areas where folks can unsubscribe if they wish.

I'm not sure why anyone would have a problem with a site owner making money. They worked for it, and it wasn't free to build in most circumstances. I think people just want to know where their money is going. Geoff

Especially if your affiliate program is harsh as well. Amazon close accounts down all the time for stuff like this. It may take a year, 5 years, 10 years, but they will catch them. Most new people are unaware too.
