Motorists often talk about their rights without thinking about their responsibilities. This is why some motorists contravene parking regulations. They are not aware of their responsibilities, or they choose to ignore them and take a risk by parking in contravention. Whatever the case may be, motorists need to be aware of their responsibilities when it comes to parking. If motorists take care of their responsibilities, their rights will take care of themselves.

Let's face it -all rights come with responsibilities attached.

So what are these responsibilities? Motorists must not cause obstructions when they park their vehicles and they must be considerate to other road users. They must park their vehicles safely and legally at all times. But what does parking legally mean? Does it mean not double parking or not parking on a single yellow line?

Most of the parking tickets issued to my vehicle were not valid because I did not unlawfully park my vehicle even though I parked on the yellow line during prescribed hours. This was because I was engaged in the lawful activity of loading or unloading, which I was entitled to do. In other words as long as motorists have a lawful reason for parking infringement, they have a valid ground for appeal if their car is issued with a parkin ticket.

If you have legally parked your car and you still receive a parking ticket - do you have any rights? Do local authorities have any responsibilities? Yes they do. Your rights are also the responsibilities of local authorities. You have a right to be told about your right to appeal. You have a right to be told about the appeal procedure and the grounds for appeal. You have a right to be told that you can appeal to the local authority in the first instance and, if you are not satisfied with the outcome, that you can appeal to an independent Parking Adjudicator.

In addition, local authority must treat motorists fairly and answer your correspondence in a timely manner.

In a nutshell, there are no rights without responsibilities.
