Post images freely? FAIR USE & DMCAREMOVAL. Is this verbiage legit?

I posted this is the writing and authoring content classroom, but maybe that wasn't the best place for it, so I'll put it here, too.

I really like how a particular website utilizes imagery in their articles, so I decided to investigate further on how they go about obtaining the images. Many of the images are linked back to pixabay, Flickr...etc. but some are not linked to anything.

This site has ads EVERYWHERE, so even though theY are not linking to products in their content, I would consider it monetized. (Is that a correct assumption?)

Anyway, I came across the following verbiage on their site, and I would love to hear thoughts on the effectiveness of it - if any.

The following is directly from the site. I have removed all references to the site itself so as to keep it anonymous.

This is a very sticky issue. The definition of "fair use" can be many things. If you are using the information to teach someone anything technically it falls under the fair use provision..My website is about parenting and children so I am trying to educate single parents by giving them tips to help them spend more time with their kids...Would it be considered teaching or not? It is a fine line!

You know Mike I have been thinking about this since I first read the post. Now lets assume you are driving in a 50 mph zone. You decide you are going to travel at 70 mph. You are stopped by the police and he is going to issue you a ticket. But you in your infinite wisdom tell the officer, "Sir I will slow down to 50 if you don't give me a ticket". I still think the ticket will be issued. If they are violating the law with known material are they not in the same situation. Just a thought.

Yep. It's an interesting thing.
Using your speeding ticket example, it's like telling the officer that you both know you were breaking the law. Then, you go into to tell him how much paperwork and administrative time is involved in issuing the ticket. Then you say that you will contest it in court, which will consume the officer's time and tax payer resources. You pair this with the argument that it is quite difficult for an officer to win in court in regard to a speeding violation, because the laws are full of grey areas. The officer may decide to just issue a warning.

Here's the point. Even though you were obviously speeding (committing copyright infringement) you made a pretty good argument for not being issued a ticket due the thought that the effort to prosecute may be worthless due to the amount of resources needed and legal grey areas (possibly questionable educational and non profit status).

Don't take this to be true. I used to explain 20+ page legal contracts around workers compensation insurance and payroll taxes to business owners.

I'm no legal expert, but I feel I have more experience in interpreting legal speak than a lot of people, and the above doesn't hold water. I think it's more of a scare tactic than anything else.

If the site was truly "non-profit" then I think they would be fine. But with the number of ads all over the place, they are obviously collecting $ on clicks, and possibly conversions (depending on the ad).

Don't do what they're doing Mike. It doesn't sound like good business practice to me.

Thanks, Marion. I don't plan to follow the lead of what is happening here. At least not until I get a professional legal opinion.

On the surface, this seems like it could be legitimate. Until they call themselves a non-profit. At that point, I just laughed, as there are ads on top of ads on this site. No product linking, but ads all over the place. Given all the ads, it is not "non-profit", and therefore doesn't qualify as a non-profit, and therefore they can not use images that are licensed as not for monetization.

I don't know if they have been busted, or if the legal verbiage scares some people away. I'll probably never know. To me, they might as well just write, "Yes, we are breaking the law. However, it is a big pain in the butt to prosecute us, so think long and hard about spending the time and resources in trying."
