Thanks both for your comments, even if fraud was not intended it still leaves you open if you use a brand name I think.

Well, it was obvious what they were trying to do in this circumstance. This was downright fraud. They deserve to get sued. I'm sure that was a very interesting court battle either way though, given people have the right to buy whatever domain name they want anyway.
