I agree, read the policy and agreement. Try to relate this with the owner of the affiliate program. It seem like this maybe a fake or spamming program.
Check with the better Business for online businesses. Check and see if they are a legit company.
If all said and done and nothing work in your favor, I would drop them quickly.

I would go back and read through the Policies of the Affiliate Program. They are supposed to declare what you will earn in there. See if you can find where it says anything about the third upgrade. See if it matches what they say. If it doesn't, write them a polite letter and reference their own policies.
