I was wondering if anyone has an experience with responding to Cease and Desist letters rather than simply deleting an entire Company review allowing them to sc

A cease and desist letter is like a warning shot across the bow. Most likely they're trying to intimidate you to take your review offline.

If they file a law suit and serve you with a complaint, then you definitely want to get legal counsel. If you don't respond to a lawsuit and don't show up to court, then they can win a default judgment against you.

I always try to avoid inflammatory language in any reviews. Even if you're right you can still be sued which will cost money that you may not have.

Basically I responded by asking to provide more details as to what they meant by saying my article was misleading.
I have also removed thir logo and CTAs on that post.
So far no response from them.

I think just like you mentioned they wanted to simply intimidate me with legal jargon more than taking any action. They probably sent such letter to all people who wrote a review about them.

I've had an MLM company try to remove a post too. I went through a lengthy negotiation with them. I think we can swap notes on this.

I have read 6 or so MLM companies policies and procedures as part of my due diligence. So am happy to do a deep dive with you on this one. My friend is also a lawyer so I can ask him about the "cease and desist" legal letter. My company never got to that stage thankfully, but I am curious whether that's just clever legal threat or something real.

I am in the review space too but don't review many MLM companies due to such strong competition from our peers here. But I don't mind standing up to bullies after trying to objectively assess the probabilities and all possible outcomes. E.g. if it was going to really cost me, I would delete the post but I'll go for the stouch/gamesmanship as far as I can take them.

I have responded yesterday asking for more clarification on "misleading" aspect in my review and I have removed their logo from my post.

So far they haven't responded back. I will let you know if they reply back.

Sounds like a nice first move - low hanging fruit - to just remove the logo and try to break down their objections.
I followed a similar approach by trying to unravel their issues, while still remaining defiant.
I would have done what you just described as "phase 1" and then proceed through the phases with them (I had 4 phases up my sleeve) and they were just a corporate suit so I wore my mob down. Every situation is different and if you need a mental contribution from me - just let me know.

It's great to hear that we can use images from other companies inventory/logo. I use businesses images. I always thought that companies I use logos and images from that I am not affiliated with was crossing the line. A company called Six Figure Mentors once sent me a threatening email which I ignored and nothing has been done about it.

Yeah Six Figure Mentors sent emails to everyone I think. I believe I also received it from them

That was Kyle and Carson WA corporate lawsuit, good article, however with an individual lawsuit it is much worse.

Hotshot lawyers are greedy especially in MLM companies and can bring an individual writer down. They are hired to invest in the companies interest. We do have to be careful to not call something a scam and get the companies angry it has happened to many of our writers here on WA.

I learned now to tread carefully in my choices of words to comparing companies.

Only the FTC can bring an MLM company down in USA. Like it happened with the MOBE scheme and many others. I admit I am not familiar with Europe or in UK, what their federal levels are. Thanks for sharing. Interesting article.

I can see where you are coming from, but the details contained within are extremely similar to Vasiliy's case. It was a single article containing facts about a company, which was requested to be taken down. You can learn a lot from the process that Kyle & Carson went through, and on how to prevent it happening to yourself. The only reason it became a corporate case, was that they found out who was behind the website. If you run an Incorporated business, it could also go from an Individual to a Corporate Law Suit.

Also, Vasiliy isn't wanting to take down the MLM, they have received a letter from the MLM, so all they want to do is to keep their article online, if it is indeed containing truths and nothing is fabricated, etc.

I don’t find it right to remove the entire article, that sounds like what MLM would love all of us do is to not write anything about them, however I will see if we can agree on something.

I agreed with the Kyles article. This is what I am keeping for later review. My goal is not to call a company a scam unless it is proven a scam by the federal government, only that entity can determine that. Like all those cash gifting MLM companies we see popping up all over and eventually the feds always gets to them and shut them down for illegal pyramid schemes. These companies rarely work, people have to constantly pay more money and more fees for upsells. Eventually, they will get caught. I just chose to tread carefully thats all in my review articles. Thanks for the clarification.

You have two options here, Vasiliy. You can either comply with the Cease and Desist letter or seek legal advice from a professional in your location. Don't expect legal advice from WA members who are not qualified. It's your @$$ that's on the line.

A cease and desist letter is like a warning shot across the bow. Most likely they're trying to intimidate you to take your review offline.

Hi Kyle/Everyone,

I see online quite a few bloggers started talking about adding visible Affiliate Disclosure to the posts where affiliate links are being used.

if you are with amazon - they sent you an email about a month and a half ago saying that you need to state the affiliate disclosure close to the affiliate link - hence mine is in my sidebar - never far away from the link
oher affiliate programs differ with their terms - read them at least yearly to see any updates.

How do you setup tracking for Starter WA Referrals/Conversions

You can track clicks but once they are here, there is no way to confirm a sign-up. You will see them under the referral tab but that doesn't help to match the click and sign up. you can put a unique URL generated from WA to track clicks and you can set up a goal in GA.
