Ever wondered what can happen if you tweet the wrong words in a tweet? If you use words that describe someone else in a defamed and or criminal way? Well you better watch your words carefully as the wrong wordings can cost you dearly.

And don't think it won't happen to you. These things happen on a daily base, but you might got lucky to get away with it as many people do not care about it or just do not know that libel is a crime and you can be prosecuted for it.

And it is not only in Twitter, this counts for any social media platform or forum, where your messages can be read by the public and it's members. Wealthy Affiliate counts as well.

Fines go from low to high, depending on the severeness of the libel and to how many people this libel went to. If you are an authority or a big brand out there, this can also influence the amount of damages you could be sued for.

Some countries even let you go to prison for criminal libel, several years of prison and a hefty fine are very normal in many countries, especially if it goes against political figures.

And what is with retweets? Well some countries will not punish you, but there are who will. As you are responsible for what you tweet and retweet and you should never handle out of neglegtence, when posting a message on social media.

USA where dreams come true, yes and with sueing it is the best place to be. The lifespan to sue someone in the United States varies from region to region, in general it can be said that you should sue within a year.

The USA is a much more interesting country to sue people and businesses as there you can easily sue for hundreds of thousands of dollars, but it may take a while before a case gets resolved. A duration of 2 or more years is fully normal for big cases, smaller libels may get resolved much faster.

But not every case goes to court, only 3.5% of all American cases do as the costs are horrendous high for the lawyer and the court costs.

Most cases get settled before they even appear in court, this saves both sides a lot of money, normally if the person who sues wins, the other party must pay their costs as well. Many settle to avoid all those costs.

To go to a lawyer, the first consultation is normally for free, but calculate any additional hour 125$ or more, so you will need some deep pockets or a good insurance to cover these costs.

If you don't care about losing a good part of the money you may receive in a settlement or after the case is won, you can find a lawyer who will take over all the costs for you but will demand between 35-44% of the amount you take out. But the good thing is, you don't have to do anything as they will pay and do all that for you.

Why is Libel so Bad for Your Business?


Whenever you are a victim of a libel, make screenshots right away and make a case file for your libel, which you can hand over to your lawyer. In this file you should also include any damages you experienced during and after the libel was put out against your good name.

Include also any kind of information that lead to this libel. Pre-tweets, anything that can help your case to sue for your damages.

Why is a libel so bad? It can damage your good name in short and long term, especially if the libel contains criminal statements. You never know how far a libel goes and how many people it reaches. This can have a long after effect as many people just believe what they read without doing their own research if the statement is true and therefore it is so damaging to you.

It will cost you clients, because they do not trust you anymore because of that statement and therefore you must take action and sue the party to get those damages paid out. Even a so called apology put in public will not clear your name for 100% as not everyone who read the first defaming message, will also read the apoplogy.

Conclusion! Think before You Write!


Before you post anything on social media, think about the consequences of your message and make sure you are not putting any kind of libel up in the first place. If you have an opinion, write as an opinion and not as a statement.

So it is important to know it has to be a statement that it will count as libel. An opinion is no libel. Should the statement be true, then it is no libel either.

Do not copycat others, as this can get you in hell's kitchen and make you an accomplice in the libel and you can get sued as well.

If a Tweeter with 600.000 followers puts a libel up against you, we talk about +- 3.600.000 people that libel tweet will reach, so yeah it is good possible. :))

Nah, I keep myself far away from politics, on the end all politicians have their goals to bring the country / Empire forward. We might like or dislike it, but we choose them to be that leader so we should accept the way they choose. Time will tell if their moves will work and if not, someone else will come and try something different that may work.

You are absolutely right, Stefan. We must pay close attention to what we say in social media and on our websites.

Just re-tweeting something we read without checking the facts, (which could also be fake), is just not smart and only serves to discredit the one re-tweeting.

If we are going to write something, we had better be ready to back it up with the real truth. We have to get our facts straight otherwise It's better to just leave it alone and mind our own business.

"Let those who are without sin cast the first stone." A lot of us know what happened after that was said.

In principal we can say defamation can also be a form of fake news, it falls under the same. Facebook is a true danger as well as many use it for their personal relationships and that can easily backfire if they get into a fight and let their words spread through there....

The reason of this post?

Well guess what, someone in the USA thought it is funny to put a criminalized tweet up against me, the tweet itself was ridiculous btw. The tweet got deleted, but the damage was done.

And so I did all the research to know, what I can do against it. And now I know how and what, so I am on my way for that as well.

I wanted to share my knowledge with you, so you can do something about it as well. :))

People easy overstep their way of expressions and it can result in childish behavior and before you know it, they got themselves in trouble.

Yesterday, a teacher lost her job, right after she tweeted about "Those *** children" delaying her train..."

There are quite a lot of insensitive Tweets going around, and if people can't take their own responsibility for what the can and cannot Tweet, they might get sued.

I find it absurd what people will Tweet, Post, and say on any Social Platform.
Enough people have lost jobs, and have been sued, in the past few years, that one would think before sending anything out into the world in such a way.

Exactly, but they forget as they are sitting in behind a computer hidden away and believe they are invincible as they have that crowd not right in front of them.

Since social media, any tweet can have a disastrous effect on the victim as such a tweet can have a far range, normally you can multiply the followers by 6 to calculate the average reach of such a message in Twitter.

People should make more use of this protective law, then the bullying on social media will stop as well.

Many do not realize that you have millions of people in front of you on social media and a bad word or statement will harm the party you targeted it at.

We are all our own reporters by now when we put messages up in social media, so we must think before we write.

I do wonder where freedom of speech is in this. Where do we draw the line between that what is a criminal offense or just a frustration over something in daily life.

I think it is rather unfair to lose a job over that. In the same time I understand that someone working with kids shouldn't say such things in social media. Just that this example I had not fired her for it.

As for your question about libel, while not on a public forum, I had a case where I could have taken someone to court for this, and maybe I should have. I just decided that they had taken enough time and energy, as it was, and it was time to move forward.

Sometimes we must sue, as suing is the only way to get your damages paid of lost customers over a longer period of time.

I think, it depends on the libel you experienced, if it was severe and you don't mind to relive the whole situation again in court, then go for it and make clear no one messes with you.
